What is an "Expungement?"

An "expungement" is a procedure by which a criminal arrest or conviction may be erased from a person's record.

Can all convictions be expunged?

We offer expungements in all counties and cities in Kansas only . Most criminal records can be expunged, but there are exceptions. Convictions for murder, rape, and for most sex crimes cannot be expunged. If you have a question about whether or not your record can be expunged, call us for a free consultation.

What are the benefits of having my record expunged?

A criminal record can make life challenging in many ways. It can affect your ability to find employment; to find a place to live; to own a legal firearm; to get a hunting license. Expunging or erasing a criminal record can remove such challenges.

Do all jurisdictions allow expungements?

Many states do not permit expungements, but the State of Kansas permits expungements in a broad range of cases. The McLean law firm handles expungements throughout the State of Kansas.

How soon after my conviction can my record be expunged?

Depending upon the crime for which you were convicted, you must wait either 3 or 5 years from the time you satisfied the sentence imposed.

What is the effect of having my record expunged?

For most purposes, your record will be erased. In most cases, you may fill out a job application and state truthfully, even under oath, that you have never been convicted of a crime.

After my record is expunged, can anyone find out about my conviction?

For most purposes, expungement erases the record of your conviction. There are a few exceptions that we will be happy to explain to you.

How long does the expungement process take?

In most cases an expungement can be complete within 60 days of the filing of the Petition. The time can vary depending upon the prosecutor and the court that is involved.

How much does an expungement cost?

The attorney fee for an expungement is generally in the range of $500-$1,000, depending upon the circumstances. Some jurisdictions charge a small filing fee, as an additional cost. We can usually estimate the total cost after your FREE initial consultation.

How do I know if I qualify for an expungement?
